Terms of Service

By accessing or using FDD Insight (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and FDD Insight.

FDD Insight provides AI-assisted analysis of Franchise Disclosure Documents (FDDs) for educational and informational purposes only. The Service processes uploaded FDD documents and generates structured summaries, extracted data, and analytical commentary using artificial intelligence models.

The Service does not provide legal advice and is not a substitute for consultation with a qualified franchise attorney. All output is provided solely for educational use to help users better understand the contents of franchise disclosure documents before consulting legal counsel.

Access to report generation is provided through one-time credit purchases. Credits are consumed when an analysis is initiated against an uploaded FDD document. Credits are non-transferable, non-shareable, and tied to the purchasing account.

Subscription plans, where available, are billed on a recurring monthly or annual basis depending on the plan selected. One-time credit packs do not create a subscription relationship unless explicitly described as such at the time of purchase.

Our refund policy is described in detail on our Refund Policy page. Credits are generally non-refundable once an analysis has been initiated.

You may use FDD Insight and its output for personal franchise due diligence purposes. If you purchase a consultant or professional plan, you may use reports for client-facing franchise due diligence support, provided that you maintain appropriate professional credentials, disclosures, and client consents, and do not present FDD Insight output as legal advice. You may not:

• Resell, sublicense, or redistribute reports generated by the Service except as expressly permitted under a consultant or professional plan
• Share reports publicly without removing any proprietary formatting or attribution
• Use the Service to provide legal, tax, financial, or franchise advisory services to third parties without appropriate professional credentials, disclosures, and client consents
• Attempt to reverse-engineer, scrape, or extract underlying AI model outputs at scale
• Upload documents you do not have the right to process

One credit is consumed per analysis run. Re-uploading the same FDD to generate additional analyses consumes additional credits.

FDD Insight owns all rights in the platform, software, report format, design, and underlying AI prompts and systems. Your uploaded FDD document remains your property (or the property of the franchisor, as applicable under copyright law).

AI-generated analysis content is licensed to you for the permitted use associated with your plan. Single-report and credit-pack users may use reports for personal franchise due diligence. Consultant or professional-plan users may use reports in client-facing workflows, subject to these Terms, provided they do not resell FDD Insight as a standalone competing product or present output as legal advice.

Monthly Consultant plans include up to 5 full FDD analyses per monthly billing period. Annual Consultant plans include up to 5 full FDD analyses per month during the annual subscription term. Unused monthly analysis allowances do not roll over. Additional reports may be purchased at the listed additional-report fee.

FDD Insight may identify contract provisions that warrant review, including non-competes, dispute resolution clauses, renewal provisions, and releases. The Service does not determine whether any provision is enforceable under the law of any particular state or jurisdiction. You should consult qualified counsel in the applicable jurisdiction.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. FDD INSIGHT DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT AI ANALYSIS WILL BE ACCURATE OR COMPLETE, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

AI-generated analysis may contain errors, hallucinations, outdated information, or material omissions. You are responsible for independently verifying any information before relying on it.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FDD INSIGHT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO FDD INSIGHT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

FDD INSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR FRANCHISE INVESTMENT LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms of Service and any dispute, claim, or controversy arising out of or in connection with the Service are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia for the resolution of any such dispute.
